   An act relating to education, and making an appropriation for the
usual current expenses of the state, to take effect immediately.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 55, O'Connell.  State Department of Education.
   Under existing law, there is in state government a State
Department of Education and the department is responsible for various
ongoing activities involving the public schools.
   This bill would appropriate $3,240,000 from the General Fund to
the State Department of Education as follows:  (1) $3,000,000 in
augmentation of the Budget Act of 1998 for executive management and
special services  and (2) $240,000 in augmentation of the Budget Act
of 1998 for the purpose of supporting the adoption of instructional
materials in the 1998-99 fiscal year.
   This bill would also, notwithstanding any other provision of law,
authorize the Director of Finance to make a loan from the General
Fund to the State Department of Education in an amount not to exceed
$2,500,000 for the purpose of assisting the department to meet cash
needs resulting from the delay in receipt of reimbursements in the
1998-99 fiscal year and would provide that interest charges on the
loan shall be waived.
   This bill would declare that it is to go into immediate effect as
an appropriation for the usual current expenses of the state.
   Appropriation:  yes.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


  SECTION 1.  The sum of three million two hundred forty thousand
dollars ($3,240,000) is hereby appropriated from the General Fund to
the State Department of Education for the following purposes:
   (a) The sum of three million dollars ($3,000,000) in augmentation
of Schedule (d) of Item 6110-001-0001 of Section 29 of the Budget Act
of 1998, Chapter 324 of the Statutes of 1998, to supplement funding
during the 1998-99 fiscal year for the ongoing activities of the
department involving the public schools.
   (b) The sum of two hundred forty thousand dollars ($240,000) for
the purpose of supporting the adoption of instructional materials in
the 1998-99 fiscal year pursuant to Chapter 481 of the Statutes of
1998.
  SEC. 2.  Notwithstanding any other provision of law, the Director
of Finance may authorize a loan from the General Fund to the State
Department of Education in an amount not to exceed two million five
hundred thousand dollars ($2,500,000) for the purpose of assisting
the department to meet cash needs resulting from the delay in receipt
of reimbursements in the 1998-99 fiscal year.  Any request by the
State Department of Education for a loan shall be made in writing to
the Director of Finance and shall be accompanied by materials
justifying the amount of the loan and establishing a schedule for
full repayment, not to exceed 90 days after the enactment of the
Budget Act of 1999.  Pursuant to subdivision (e) of Section 16314 of
the Government Code, interest charges on the loan shall be waived.
  SEC. 3.  This act makes an appropriation for the usual current
expenses of the state within the meaning of Article IV of the
Constitution and shall go into immediate effect.
